Ron Simon & Associates, together with co-counsel Gomez Trial Attorneys, has filed the first Nara Organics botulism lawsuit in the Superior Court of California, County of Riverside. The complaint, brought on June 17, 2026, is on behalf of a 3-month-old infant identified only by the initials P.R. The lawsuit names Nara Organics, the manufacturer of the recalled formula, and Target, the retailer that sold it, as defendants.
This is the first known lawsuit filed in connection with the infant botulism illnesses linked to Nara Organics Whole Milk Organic Powdered Infant Formula. The filing was reported in a PR Newswire release dated June 17, 2026. You can read the full recall details, lot codes, and FDA timeline on our Nara Organics infant formula botulism outbreak page.
"Infant formula is one of the few products that parents must trust completely and without question," said Ron Simon of Ron Simon & Associates.
What the Lawsuit Alleges
Ron Simon & Associates alleges that the Nara Organics formula P.R. consumed was unsafe for its intended use, and that Nara Organics and Target failed to ensure the product was safe and failed to adequately warn families of the risk. The firm's complaint seeks to hold both the manufacturer and the retailer accountable.
These are allegations. Liability has not been decided by any court. The undisputed facts of the recall, the hospitalizations, and the regulatory actions are described below as a matter of public record, while questions of fault and causation remain claims to be proven.
What Happened to Infant P.R.
P.R., the 3-month-old infant represented by Ron Simon & Associates, was transferred from Southwest Healthcare Rancho Springs Hospital to Permanente Fontana Medical Center for emergency care. The infant spent about ten days in the hospital and was treated with BabyBIG, the Botulism Immune Globulin Intravenous antitoxin used for infant botulism, before being discharged on May 28, 2026. P.R. continues to require medical treatment.
To protect the family's privacy, the child is referred to only as P.R. The parents are not named.
The Nara Organics Infant Botulism Formula Recall
Health officials have linked infant botulism, a serious illness caused by the toxin produced by Clostridium botulinum bacteria, to Nara Organics powdered infant formula. Three infants were hospitalized across California, Pennsylvania, and Washington. There have been no reported deaths, and all three infants were treated with BabyBIG.
Illness onsets occurred from April through May 2026, the most recent on May 31, 2026. The U.S. Food and Drug Administration recommended a recall on June 12, 2026, and Nara Organics issued a voluntary recall of all lots on June 13, 2026.
Recalled Products
This infant botulism formula recall covers all lots of Nara Organics Whole Milk Organic Powdered Infant Formula in two can sizes:
- 24.7 oz (700 g) can, UPC 860013251901
- 14.1 oz (400 g) can, UPC 860013251918
The lot code is printed on the bottom of each can. The formula was sold at Target, Target.com, and Nara.com, and was distributed nationally from July 2025 through June 2026. The product was manufactured in Europe. Parents are urged not to feed any Nara Organics formula to an infant, regardless of the lot code. For the complete lot list and recall guidance, see our Nara Organics infant formula botulism outbreak page.
Important: The Investigation Is Ongoing
As of June 13, 2026, the Nara Organics formula had not tested positive for Clostridium botulinum. The recall was issued as a precaution because all three sick infants had consumed Nara Organics formula. State laboratories are testing leftover formula collected from affected families, and results are expected within weeks. The FDA and CDC investigation remains open, and findings may change as testing concludes. You can follow the official updates on the FDA recall page and the CDC outbreak page.
A Second Infant-Formula Botulism Outbreak in Under a Year
This is the second infant-formula botulism outbreak to draw federal attention in under twelve months. In November 2025, the FDA investigated a separate infant botulism outbreak linked to ByHeart Whole Nutrition Infant Formula, which sickened dozens of infants and was the first-ever infant botulism outbreak tied to powdered infant formula. Two formula-linked clusters in such a short window have raised serious questions for parents about how these products are tested and monitored before they reach store shelves.
What Is Infant Botulism?
Infant botulism happens when a baby ingests Clostridium botulinum spores that grow in the immature gut and release a nerve toxin. It is a medical emergency.
Infant Botulism Symptoms and How Long They Take to Appear
Symptoms parents should watch for include:
- Constipation, often the first sign
- Poor feeding or a weak suck
- A weak or altered cry
- Drooping eyelids and decreased facial expression
- Loss of head control and muscle weakness
- Difficulty breathing
Symptoms can take days to several weeks to appear after a baby consumes contaminated food. If your baby shows any of these signs, seek emergency medical care immediately. For detailed medical guidance, consult the CDC's infant botulism clinical overview and your pediatrician.
"We intend to hold Nara Organics fully accountable," Simon added.
Who Can File a Claim, and What Damages May Be Covered
If your infant consumed Nara Organics formula and developed infant botulism or symptoms consistent with it, your family may have grounds for a product liability claim. Families pursuing these claims may seek compensation for medical and hospitalization costs, future medical care, pain and suffering, and other damages allowed by law.
Every situation is different, and no result can be promised. Speaking with a lawyer does not commit you to a lawsuit. A consultation simply helps you understand whether your family may be eligible to pursue a claim.
